These Terms of Service ("Terms") govern your use of clearedrcm.com ("the Site") and any informational materials we publish through it. Cleared RCM™ is a service of Vision BI LLC, a Florida limited liability company ("Cleared RCM", "we", "us").
If you become a client of Cleared RCM, the services we provide are governed by a separate written agreement. Including a Business Associate Agreement under HIPAA. These Terms apply to your use of the Site, not to those services.
Acceptable use
You agree to use the Site only for lawful purposes. You will not:
- Attempt to gain unauthorized access to the Site or its underlying systems.
- Use the Site to transmit malware, harmful code, or unsolicited bulk communications.
- Scrape, harvest, or otherwise extract data at a volume or frequency that interferes with normal operation.
- Misrepresent your identity in any communication or form submission.
Site content
Content on the Site. Including text, graphics, the Cleared RCM mark, and the design of the Site itself. Is the property of Vision BI LLC or its licensors. You may view the content for your own evaluation and internal business use. Republication, modification, or commercial use without written permission is not permitted.
Industry statistics referenced on the Site are drawn from publicly available sources or generally accepted industry benchmarks. They are provided for informational purposes and do not constitute a representation about results we have produced for any specific client.
No professional advice
Content on the Site is for general information. It is not legal, accounting, tax, billing, or clinical advice. Decisions about billing, compliance, payer contracts, or clinical operations should be made with appropriate licensed professionals familiar with your specific facts.
Form submissions and email
When you submit the contact form or email us, you are not entering into an engagement. An engagement begins only when we both sign a written agreement. Including the applicable Business Associate Agreement. Describing the services and terms.
Do not include Protected Health Information ("PHI") in inquiry messages. The contact form is not a HIPAA-secure channel. If you need to share PHI for an audit or scoping, we will set up a secure transfer method first.
Third-party links
The Site may link to third-party resources (payer policies, industry articles, software vendors). We do not control those resources and are not responsible for their content or practices.
Disclaimers
The Site is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free from harmful components.
Limitation of liability
To the maximum extent permitted by law, Vision BI LLC and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site. Where liability cannot be excluded, our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
Nothing in these Terms limits any liability that cannot be excluded under applicable law.
Indemnity
You agree to indemnify and hold harmless Vision BI LLC from any claim arising out of your unlawful or unauthorized use of the Site, or your breach of these Terms.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Continued use of the Site after a change means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. The state and federal courts located in Florida have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site.
